The Indian Constitution does not recognize property right as a fundamental right. In the year 1977, the 44th amendment eliminated the right to acquire, hold and dispose of property as a fundamental right. However, in another part of the Constitution, Article 300 (A) was inserted to affirm that no person shall be deprived of his property save by authority of law. The result is that the right to property as a fundamental right is now substituted as a statutory right. / भारतीय संविधान संपत्ति के अधिकार को मौलिक अधिकार के रूप में मान्यता नहीं देता है। वर्ष 1977 में, 44वें संशोधन ने संपत्ति के अधिग्रहण, धारण और निपटान के अधिकार को मौलिक अधिकार के रूप में समाप्त कर दिया। हालांकि, संविधान के एक अन्य भाग में, अनुच्छेद 300 (ए) को यह पुष्टि करने के लिए डाला गया था कि कानून के अधिकार के बिना किसी भी व्यक्ति को उसकी संपत्ति से वंचित नहीं किया जाएगा। इसका परिणाम यह हुआ कि संपत्ति के अधिकार को मौलिक अधिकार के रूप में अब वैधानिक अधिकार के रूप में प्रतिस्थापित किया गया है।
